Instructions on the Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (TDJ Stadtgärtner GmbH, Frieslandstraße 5, 48527 Nordhorn, Germany, hallo@diestaadtgaertner.de, Telephone: +49-(0)5921-8183927) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, although it is not mandatory. You may also exercise your right of withdrawal online at https://form.jotform.com/261673537624059 or via our returns portal https://returns-portal.xentral.com/create-return?id=vNYgyhuRvAJhI0CUV4eM&projectId=6. If you use this online function, we will immediately send you an acknowledgement of receipt on a durable medium (e.g. by email), including information about the content of the withdrawal notice and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from your choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must send or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Special Notes
If you finance this contract with a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly assumed if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been paid to us when the withdrawal takes effect, your lender shall assume our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if this contract concerns the acquisition of financial instruments (e.g. securities, foreign currencies or derivatives).

If you wish to avoid being contractually bound as extensively as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you have a right of withdrawal for that agreement as well.
