Terms and Conditions of Participation

Participation in the contest by Die Stadtgärtner, hereinafter referred to as the operator or organizer, is free of charge and is exclusively subject to these terms and conditions of participation.

Contest Duration

The contest runs from 02.04.2026, 6:00 AM until 03.04.2026, 12:00 AM. During this period, users have the opportunity to participate online in the “Stadtgärtner April” contest.

Participation

To participate in the contest, tagging a person on Instagram is required.
Participation in the contest is free of charge.

Eligibility

Eligible to participate are natural persons residing in Germany, Switzerland, or Austria who have reached the age of 14. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods, services, or newsletter registration.

If a participant has limited legal capacity, the consent of their legal representative is required.

Persons involved in the conception and implementation of the contest, employees of the operator, and their family members are not eligible to participate. Furthermore, the operator reserves the right to exclude persons from participation at its own discretion if justified reasons exist, for example

(a) in case of manipulation related to access to or execution of the contest,
(b) in case of violations of these terms and conditions,
(c) in case of unfair conduct, or
(d) in case of false or misleading information related to participation in the contest.

Prize, Notification of Win, and Delivery of Prize

The following prizes will be awarded:

The winners will be determined after the participation deadline in calendar week 15 by a random draw among all participants. If the contest is linked to a task, only those participants who have correctly completed the task will be included in the draw.

The winners of the draw will be promptly informed about their win via a message on Instagram.

The prize will be handed over exclusively to the winner or the legal representative of the minor winner. Exchange, self-collection, or cash payment of the prize is not possible.

Any costs incurred for shipping the prizes will be covered by the operator. Additional costs associated with claiming the prize are the responsibility of the winner. The winner is responsible for any applicable taxation of the prize.

If the winner does not respond within one week after being contacted, the prize may be transferred to another participant.

Termination of the Contest

The organizer expressly reserves the right to terminate the contest without prior notice and without providing reasons. This applies in particular to any reasons that would disrupt or prevent the planned course of the contest.

Data Protection

Providing personal data is necessary to participate in the contest. The participant assures that the personal information provided, especially first name, last name, and email address, is truthful and correct.

The organizer points out that all personal data of the participant will neither be passed on to third parties nor made available to them for use without consent.

Only the operator/organizer may collect, store, and use the data for the purpose of conducting the contest. The operator will delete the personal data collected during this contest after the contest ends.

In the event of a win, the winner agrees to the publication of their first name and place of residence in the advertising media used by the organizer. This includes announcing the winner on the operator’s website and social media platforms.

The participant can revoke their consent at any time. The revocation must be made in writing to the contact details provided in the imprint section of the operator’s website. After revocation, the collected and stored personal data of the participant will be deleted immediately.

Applicable Law

Questions or complaints related to the contest should be directed to the operator. Contact details can be found in the imprint section of the operator’s website.

The contest is exclusively subject to the law of the Federal Republic of Germany. Legal recourse is excluded.

Severability Clause

If any provision of these terms and conditions is or becomes wholly or partially invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, the legally permissible regulation that comes closest economically to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a regulatory gap in these terms and conditions.
